Patent Frequently Asked Questions

Clear starting points for questions about applications, costs, timing, and next steps.

What is the difference between a provisional and a utility application?

A provisional application can establish an early filing date for adequately disclosed subject matter but is not examined and does not itself become a patent. A nonprovisional utility application is examined. See the provisional and utility application pages for more detail.

Can I protect how my product looks?

A design patent may protect ornamental appearance. A utility patent may protect functional features. Some products warrant considering both types of applications.

Does patent pending mean I have a patent?

No. Patent pending indicates that an application has been filed and remains pending; it does not mean that a patent has been granted.

How much does a patent application cost?

Costs depend on the application type, complexity, drawings, government fees, and work needed during examination. Request an estimate that distinguishes preparation, filing, and later work. Current government fees are available from the USPTO.

How long does it take to get a patent?

Timing varies with the application, examination workload, and responses needed. Filing does not guarantee approval. Discuss timing and any available examination options for your circumstances.

Does a U.S. patent protect me worldwide?

No. Patent rights are territorial. A PCT application provides a coordinated international filing route, followed by national or regional proceedings; it does not grant a worldwide patent.

What should I do if I receive an Office Action?

Keep the complete notice and seek review promptly. The required response and deadline depend on the notice. Do not assume an extension is available.

What should I prepare for an initial discussion?

Prepare a short description of the invention, available sketches, relevant filing dates, and any planned launch or disclosure dates. Contact the firm to arrange how detailed materials should be shared.
